The acceptance of these General Terms and Conditions by confirmation is a mandatory condition for providing the services offered by &#8220;Oblache Bialo&#8221; LTD.<\/p><p><\/p><ol><li><strong> <\/strong><strong>Definitions:<\/strong><\/li><\/ol><p><\/p><p>For the purposes of these General Terms and Conditions, the following definitions of the concepts mentioned below have been adopted:<\/p><p><\/p><ul><li>&#8220;User&#8221; &#8211; any adult individual who enters into a contract for the services offered by &#8220;Oblache Bialo&#8221; LTD, which are not intended for commercial or professional activity.<br \/><br \/><\/li><li>&#8220;Student&#8221; &#8211; any individual, including and a minor who uses the services through a contract concluded by a User.<\/li><\/ul><p><\/p><ul><li>&#8220;Website&#8221; &#8211; <span><a href=\"https:\/\/oblachebialo.com\/\">https:\/\/oblachebialo.com\/<\/a><\/span> and all subpages.<\/li><\/ul><p><\/p><ul><li>&#8220;Service&#8221; &#8211; any educational service provided by &#8220;Oblache Bialo&#8221; LTD.<\/li><\/ul><p><\/p><ul><li>&#8220;Service Agreement&#8221; &#8211; an agreement between &#8220;Oblache Bialo&#8221; LTD and the User of services offered on the Website https:\/\/oblachebialo.com\/, by virtue of which &#8220;Oblache Bialo&#8221; LTD undertakes to provide the User with a specific service, and the latter to pay for it.<\/li><\/ul><p><\/p><ul><li>&#8220;General Terms and Conditions&#8221; &#8211; these General Terms and Conditions for the provision of services, as well as the published ones on the Website <span><a href=\"https:\/\/oblachebialo.com\/\">https:\/\/oblachebialo.com\/<\/a><\/span> Terms of Use, Cookie Policy, Personal Data Protection Policy, Policy for the Protection of the Rights and Interests of the Child-Student.<\/li><\/ul><p><\/p><ul><li>&#8220;Unforeseen circumstances&#8221; &#8211; circumstances that arose after the conclusion of the contract, which is not the result of an action or inaction of the parties, which could not have been foreseen when exercising due care, and make it impossible to perform the contract under the agreed conditions, for example, a disaster, war, interruption of communications as a result of unforeseen circumstances.<\/li><\/ul><p><\/p><p><strong>\u00a0<\/strong><\/p><ul><li><strong> <\/strong><strong>Services provided and for whom they are intended:<\/strong><ul><li>&#8220;Oblache Bialo&#8221; LTD provides the following services:<\/li><\/ul><\/li><\/ul><p><\/p><ul><li>Individual virtual lesson in Bulgarian;<\/li><li>Group virtual lesson in Bulgarian \/in groups of 2, 3, 4 students\/;<\/li><\/ul><p><\/p><ul><li>The services are offered in a package of 4 or 8 lessons.<\/li><\/ul><p><\/p><ul><li>The duration of a lesson can be 45 min., 60 min., or 90 min. Each lesson of 90 min. necessarily includes a break lasting 5 min.<\/li><\/ul><p><\/p><ul><li>The lessons are remote, taking place in a virtual school with a teacher, at a time convenient for the Student, and the frequency is not less than one lesson per week.<\/li><\/ul><p><\/p><ul><li>The Services are intended for:<\/li><\/ul><p><\/p><p>&#8211; children from 8 to 12 years of age and young people from 12 to 18 years of age who have Bulgarian roots are part of Bulgarian families living abroad or from families of people of different nationalities, of which one partner is Bulgarian;<\/p><p>&#8211; persons over 18 years of age who are in a partnership or family relationship with Bulgarians.<\/p><p><\/p><p>III.6. It is desirable that the Student has at least minimal support in studying at home from a person who knows the Bulgarian language.<\/p><p><strong>\u00a0<\/strong><\/p><ol><li><strong> <\/strong><strong>Conclusion of a contract for the use of the services offered through the Website https:\/\/oblachebialo.com\/.<\/strong><ul><li>The &#8220;Get started, it&#8217;s easy!&#8221; section of the Website describes the procedure for starting and organizing the studying.<\/li><\/ul><\/li><\/ol><p><\/p><ul><li>To obtain more information about the services offered by &#8220;Oblache Bialo&#8221; LTD, identify the needs of the user, as well as provide answers to any additional questions in connection with the services offered, through Calendly the User could choose a convenient time to talk to an expert from the office of &#8220;Oblache Bialo&#8221; LTD. In this conversation, the user could ask all his questions and clarify any ambiguities. Through this conversation, the needs of the User are identified &#8211; who will study and how much time will be spent on the Bulgarian language; whether Bulgarian is spoken at home and whether there is someone to help the student at home; it is specified which are the most suitable lessons and when the studying could start.<br \/><br \/><\/li><li>The user has the opportunity to conclude contracts for the offered services through the website interface.<\/li><\/ul><p><\/p><ul><li>With an e-mail message, &#8220;Oblache Bialo&#8221; LTD offers a day and time, as well as a teacher to conduct the desired lessons. The user receives access credentials (name and password) for the virtual school where the lessons are held. A date is scheduled for the first lesson, which is free for all new students and in which the student&#8217;s level of Bulgarian language proficiency is determined.<\/li><li>After the first lesson, the User decides whether to purchase the selected lesson package. With an e-mail message, &#8220;Oblache Bialo&#8221; LTD provides the User with login data (username and password), which should be entered in the &#8220;GO TO PROFILE HERE&#8221; section of the Website https:\/\/oblachebialo.com\/. The user has the opportunity to enter and change his data in his user profile on the site.<\/li><\/ul><p><\/p><ul><li>In case that the User has already used the services of &#8220;Oblache Bialo&#8221; LTD and wishes to purchase a new package of lessons, the User contacts the office of &#8220;Oblache Bialo&#8221; LTD by email or through Calendly to reserve a convenient time for him to clarify the details the new lesson pack.<\/li><\/ul><p><\/p><ul><li>With an e-mail message, &#8220;Oblache Bialo&#8221; LTD offers a schedule, as well as a teacher to conduct the desired lessons.<\/li><\/ul><p><\/p><ul><li>Through his profile on the site, the User pays for the selected package of lessons and receives information about the schedule of lessons.<\/li><\/ul><p><\/p><ul><li>The user can enter into a service contract with \u201cOblache Bialo\u201d LTD only after the trial lesson.<\/li><\/ul><p><\/p><ul><li>The service contract is considered concluded from the moment of confirmation of the order by &#8220;Oblache Bialo&#8221; LTD and its payment (or payment of an initial installment) by the User.<br \/><br \/><\/li><li>If it is impossible to provide a given service, &#8220;Oblache Bialo&#8221; LTD reserves the right to refuse the order.<\/li><\/ul><p><\/p><ul><li>&#8220;Oblache Bialo&#8221; LTD has the right to refuse to enter into a contract with an incorrect User. &#8220;Oblache Bialo&#8221; LTD reserves the right to treat a User as incorrect in cases where:<br \/><br \/><\/li><\/ul><p>&#8211; there is non-compliance with the General Terms and Conditions by the User;<\/p><p>&#8211; an incorrect, arrogant, or rude attitude towards the representatives of &#8220;Oblache Bialo&#8221; LTD has been established;<\/p><p>&#8211; systematic abuses by the User against &#8220;Oblache Bialo&#8221; LTD have been established.<br \/><br \/><\/p><p><\/p><ol><li><strong> <\/strong><strong>Virtual School:<\/strong><ul><li>The study takes place in the so-called &#8220;virtual school&#8221; &#8211; the LearnCube platform, which is adapted for \u201cOblache Bialo\u201d LTD and is available at <span><a href=\"https:\/\/oblachebialo.live-online-classes.com\">https:\/\/oblachebialo.live-online-classes.com<\/a><\/span>. <br \/><br \/><\/li><li>The students can at any time log into their virtual school account using the &#8220;TO THE SCHOOL&#8221; button on the Website <span><a href=\"https:\/\/oblachebialo.com\/\">https:\/\/oblachebialo.com\/<\/a><\/span> and use or change their personal data there, as well as attend classes scheduled by the office of &#8220;Oblache Bialo&#8221; LTD. The schedule of classes is determined by the office of &#8220;Oblache Bialo&#8221; LTD after the payment for the package of selected lessons.<\/li><\/ul><\/li><\/ol><p><\/p><ul><li>A few hours before each lesson, the Student receives a reminder at the e-mail address provided by him, and the reminder contains a link to the virtual classroom in the learning platform. The student can join the lesson directly using the link sent.<\/li><\/ul><p><\/p><ul><li>All lessons in the virtual school are video-recorded, which is available up to 30 days from the date of the lesson.<\/li><\/ul><p><\/p><ul><li>The technical requirements for using the virtual school are as follows:<br \/><br \/><\/li><\/ul><ul><li>Web browser: Google Chrome or Mozilla Firefox recommended;<\/li><li>Internet connection: 1 Mbps;<\/li><li>Operating System: Windows 7, 8, 8.1, 10, Linux (Ubuntu 13.04 or later), Mac OS X (10.9 or later);<\/li><li>Screen resolution: 1366 x 768 px;<\/li><li>RAM: 3 GB;<\/li><li>Web camera: External or built-in;<\/li><li>Headset: It is recommended to use a headset instead of speakers and\/or a built-in microphone.<br \/><br \/>A technical test is performed every time you enter the virtual school.<\/li><\/ul><p><\/p><ul><li>In case that a Student cannot keep the time of a planned individual lesson, the Student or the parent-User should notify the office of &#8220;Oblache Bialo&#8221; LTD at e-mail: office@oblachebialo.com not less than 24 hours before the lesson, to be able to reschedule it. Otherwise, the lesson is considered missed. The team of &#8220;Oblache Bialo&#8221; does not tolerate frequent changes in the schedule of planned study hours. In the event that the student or the parent-User does not notify &#8220;Oblache Bialo&#8221; LTD that the student will not be able to keep the scheduled time of the lesson within the time limit specified in the previous sentence, the prepaid amount for this lesson will be lost in full and the lesson will not be rescheduled for other date and time.<br \/><br \/><br \/><\/li><li>In case that a Student misses a scheduled group lesson, the prepaid amount for that lesson is lost in full and the lesson cannot be rescheduled. In the event that the parent-User or the Student wishes to catch up on the missed learning material in an individual lesson, this lesson must be paid in agreement with the office of &#8220;Oblache Bialo&#8221; LTD.<\/li><\/ul><p><\/p><ul><li>In case that a Student cannot keep the time of a planned group lesson, the Student or the parent-User should notify the office of &#8220;Oblache Bialo&#8221; LTD at e-mail: office@oblachebialo.com no less than 48 hours before the lesson, to make it possible to reschedule it. The parent-Users of the other Students in the group must agree for the lesson to be rescheduled for another date. If one of the Parent Users does not agree to the group lesson being rescheduled for another date and time, then the lesson is held according to the established schedule.<br \/><br \/><\/li><li>In case that the lesson cannot be held due to the fault of the teacher or due to technical difficulties related to the software or equipment used by &#8220;Oblache Bialo&#8221; LTD, this lesson is not lost but is rescheduled for another date and time.<\/li><\/ul><p><\/p><ul><li>When conducting the lessons in the virtual school, the Students are not graded, the goal is for the Students to make remarkable progress in the Bulgarian language through fun learning.<br \/><br \/><\/li><li>All learning materials in the virtual school are electronic and accessible there.<br \/><br \/><\/li><li>Data regarding the Student&#8217;s performance and progress in the virtual school is provided to his parent who, as an adult User, has paid for the service.<\/li><\/ul><p><\/p><ul><li>Upon completion of the series of lessons from the purchased bundle, the User is given the opportunity to purchase a &#8220;New Series of Lessons&#8221; with the same parameters or to request a change to the office of &#8220;Oblache Bialo&#8221; LTD.<\/li><\/ul><p><\/p><ul><li>Communication between teacher and student, except in the virtual school, is carried out by e-mail, Viber or Skype.<\/li><\/ul><p><strong>\u00a0<\/strong><\/p><ol><li><strong> <\/strong><strong>Prices and payment methods.<\/strong><ul><li>The prices of the offered services are indicated on the website of &#8220;Oblache Bialo&#8221; LTD at the time of placing an order, except in cases of obvious error. They include VAT, in the cases in which its charging is provided.<\/li><\/ul><\/li><\/ol><p><\/p><ul><li>&#8220;Oblache Bialo&#8221; LTD reserves the right to change the prices of the services offered on the site at any time and without notice, and the changes made in this way do not affect orders already made.<\/li><\/ul><p><\/p><p><\/p><ul><li>\u201cOblache Bialo\u201d LTD may provide discounts for services offered on the Website. The rules applicable to such discounts are determined by \u201dOblache Bialo\u201d LTD. Different types of discounts cannot be combined when ordering and purchasing the same service, unless such a possibility is expressly provided for.<\/li><\/ul><p><\/p><ul><li>Payment is made after the first free lesson or when purchasing a new lesson package.<br \/><br \/><\/li><li>The user can pay for the offered services via MyPos or via bank transfer.<\/li><li>In the event that the User selects a payment method involving a third-party payment service provider, the User may be bound by the terms and conditions and\/or fees of that third party.<br \/><br \/><\/li><li>&#8220;Oblache Bialo&#8221; LTD is not responsible if a payment method involving a third-party payment service provider is unavailable or otherwise inoperative for reasons beyond the fault of &#8220;Oblache Bialo&#8221; LTD.<\/li><\/ul><p><\/p><ul><li><strong> <\/strong><strong>Right of withdrawal.<\/strong><ul><li>The user has the right to cancel the concluded service contract within 14 days after paying for the service, without giving a reason, in which case the prepaid amount for spent group or individual lessons will not be refunded.<\/li><\/ul><\/li><\/ul><p><\/p><ul><li>The user has no right to withdraw from the contract if the service subject to the contract has been fully provided.<\/li><\/ul><p><\/p><ul><li><strong><span> <\/span><\/strong><strong>Amendment of the general terms and conditions<\/strong><ul><li>&#8220;Oblache Bialo&#8221; LTD notifies the User of any change in the present general terms and conditions within 7 days of the occurrence of this circumstance at the e-mail address specified by the User.<\/li><\/ul><\/li><\/ul><p><\/p><ul><li>When he does not agree with the changes in the General Terms and Conditions, the User has the right to withdraw from the contract without giving a reason and without paying compensation or penalty. In order to exercise this right, the User should notify the office of &#8220;Oblache Bialo&#8221; LTD by e-mail within one week of receiving the message under the previous article.<\/li><li>In the event that the User does not exercise his right to withdraw from the contract in accordance with the procedure set out in these General Terms and Conditions, it is considered that the amendment has been accepted by the User without objection.<\/li><\/ul><p><\/p><p><\/p><ol><li><strong> <\/strong><strong>Governing Law and Dispute Resolution<\/strong><ul><li>The provisions of the current legislation of the Republic of Bulgaria apply to all matters not settled by these General Terms and Conditions.<\/li><\/ul><\/li><\/ol><p><\/p><ul><li>All disputes between the User and &#8220;Oblache Bialo&#8221; LTD are resolved through negotiations, mutual concessions, and in a spirit of cooperation.<\/li><\/ul><p><\/p><ul><li>In case that a solution is not found, the parties could try to resolve their dispute through mediation or refer it to a conciliation commission by initiating voluntary conciliation proceedings.<br \/><br \/><\/li><li>In case that the User considers that his rights have been violated, the User has the right to appeal to the CPC.<\/li><\/ul><p><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Subject: These general conditions regulate the relationship between &#8220;Oblache Bialo&#8221;
